Latham & Watkins Lawyer Now SEC General Counsel

Top securities lawyer and former astrophysicist Brian G. Cartwright will be joining the Securities and Exchange Commission on Jan. 23 as its general counsel, replacing Giovanni Prezioso, who plans on returning to private practice shortly after a transition period.

Cartwright has been a partner at Latham & Watkins and has been a lawyer since 1980, when he graduated from Harvard Law School. In his first career, he was an astrophysicist at the University of California, Berkeley, after graduating from Yale University in 1967 with a Ph.D. in physics.

"As the top lawyer for the SEC - the investor's advocate - the general counsel is also the nation's foremost legal advocate for investors," SEC Chairman Christopher Cox said in a statement. "Brian Cartwright will be a relentless and powerful champion for investors and will continue the SEC's tradition of exceptional professionalism. His talent, tenacity and insight will serve the Commission, the capital markets and investors well."

SEC Enforcement Attorney Joins Deloitte as Partner

Former Securities and Exchange Commission enforcement attorney Howard A. Scheck has joined Deloitte Financial Advisory Services as a partner in its forensic and dispute services practice, based in Washington. Scheck was formerly the Washington branch chief for the SEC's office of associate director, division of enforcement.

In his new role, Scheck will work closely with law firms, corporate counsel and audit committees and conduct investigations arising from civil and criminal enforcement inquiries, as well as private lawsuits.

"Howard is a certified public accountant and an attorney who brings invaluable experience in investigating and evaluating allegations of accounting fraud, internal controls violations and disclosure failures to our expanding practice," said William O'Connell, national service line leader of Deloitte's forensic and dispute services practice.

Scheck spent 11 years with the SEC, during which he participated in prosecuting more than 25 enforcement actions related to accounting fraud, market manipulation and insider trading. He also wrote the enforcement division's internal training guide for conducting accounting fraud investigations and used it as a guide for helping the enforcement staff to conduct both formal and informal inquiries.

"Working within the enforcement division enabled me to experience firsthand how the government pursues financial reporting misdeeds. During my tenure, the SEC brought many ground-breaking enforcement actions, and I am honored to have done my part," Scheck said.
