Auerbach Joins ICI to Lead Financial Services Policy

Donald C. Auerbach, a veteran of both Capitol Hill and the financial services industry, has been named director of financial services policy at the Investment Company Institute.

After five years of working for U.S. House of Representatives Congresswoman Carolyn Maloney (D-NY) as an advisor for her duties as a member of the financial services committee, Auerbach will take over the ICI's responsibilities that deal with appearing before Congress and other federal government officials.

"Don's knowledge of financial services issues, his familiarity with the House financial services committee and Capitol Hill are tremendous assets," said ICI Government Affairs Officer Dan Crowley.

Auerbach has also worked on the National Committee for an Effective Congress and for Federal Financial Analytics, formerly ISD/Shaw.

SEC Promotes Bresnan In Enforcement Division

The Securities and Exchange Commission has named Peter H. Bresnan as an associate director in its enforcement division. Bresnan, who was deputy chief litigation counsel of the SEC's division of enforcement since November 2001, now holds a leading role in charting the Commission's investigation and enforcement actions. Between November 2003 and April 2004, Bresnan also functioned as district administrator in the SEC's Boston-area operations.

Stephen M. Cutler, director of enforcement at the SEC, praised Bresnan as "an outstanding lawyer and thinker." Cutler added, "We are fortunate that Peter will continue to contribute his extraordinary talents to the Commission's enforcement program."

Bresnan joined the SEC in 1995 as assistant chief litigation counsel and has since prosecuted numerous high-profile cases. For example, Bresnan was the lead trial counsel in the WorldCom case, which led to the largest civil penalty paid by a U.S. corporation for violating federal securities laws. Bresnan also recently directed the SEC's market-timing cases against Putnam and MFS.

PEA Capital Names Replacement for CEO

PEA Capital, a PIMCO sister company, has hired Oppenheimer Capital CEO Bruce Koepfgen to replace Ken Corba, who quit the firm as CEO on April 13 due to market-timing allegations.

Since Allianz, the German insurance company that owns PEA and PIMCO, also owns Oppenheimer, Koepfgen will continue to serve as Oppenheimer's CEO as he takes on the same task at PEA.

Koepfgen came to Oppenheimer last year, after serving as a managing director for Salomon Brothers.
